NOTICE OF SALE UNDER POWER, GLYNN COUNTY Pursuant to the Power of Sale contained in a Security Deed given by James P. O'Grady and Judith O'Grady to Mortgage Electronic Registration Systems, Inc. as nominee for SIRVA Mortgage, Inc. dated 5/15/2008 and recorded in Deed Book 2436 Page 394 Glynn County, Georgia records; as last transferred to or acquired by CitiMortgage, Inc., conveying the after-described property to secure a Note in the original principal amount of $ 388,500.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Glynn County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on May 02, 2017 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: All of that certain lot, tract or parcel of land situate, lying and being in the 25th G.M.D., Glynn County, Georgia , on the Island of St. Simons therein, and in that certain subdivision thereon known as "Phase V & A Revision of Lots 122, 123 and 124, Phase IV, Harrison Pointe" described and identified according to the map and plan thereof prepared by Shupe Surveying Company, P.C. and certified by Gary R. Nevill, Georgia Registered Land Surveyor No. 2401, under date of November 21, 1995 and recorded in the Office of the Clerk of the Superior Court of Glynn County, Georgia in Plat Drawer 23, as Map No. 147, as ALL OF LOT NUMBERED ONE HUNDRED TWENTY-SEVEN (127), PHASE V, HARRISON POINTE SUBDIVISION. Said real property, together with the improvements currently located thereon, being more particularly described and identified according to a plat of survey prepared by Johnson Land Surveyors for Louisa LeRoux Knight and certified by Charles L. Johnson, Georgia Registered Land Surveyor No. 2640, dated December 2, 2005, an original print of which is attached to that certain warranty deed dated December 22, 2005, from Kristen Jaje Jones (who was formerly known as Kristen Jaje) to Louisa LeRoux Knight recorded in Deed Book 1842, Page 391, aforesaid records. Reference is made to the aforesaid Shupe/Nevill plat of survey and to said Johnson plat of survey and to the record of each for the purpose of more particularly describing the location, metes and bounds of subject property and for all other purposes. This being the same property conveyed by that certain warranty deed dated December 22, 2005 from Kristen Jaje Jones (formerly known as Kristen Jaje) to Louisa Leroux Knight and recorded in Deed Book 1842, Page 391, aforesaid records. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property is commonly known as 127 Newfield Street, Saint Simons Island, GA 31522 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): James P. O'Grady and Judith O'Grady or tenant or tenants. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
