Sheriff's Sale Georgia, Glynn County Will be sold before the Courthouse door of said County on the first Tuesday in April, 2017 at 10:00 A.M. to the highest bidder for cash, the following property: Levied on as property of Elizabeth K. Bassett: Under and by virtue of O.C.G.A. Section 44-3-109(c), the Declaration of Condominium for Ocean Walk, A Condominium, recorded in Deed Book 553, Page 85 in the real property records of the Office of the Clerk of Superior Court of Glynn County, as may be amended from time to time (the "Declaration"), and the Judgment and Order Foreclosing Lien entered by Judge Gregory A. Adams in the Superior Court of DeKalb County, Georgia on June 22, 2016, in the matter of Ocean Walk Condominium Association, Inc. v. Zelma R. Kellam, Civil Action Number 16CV2529-5, there will be sold by the Glynn County Sheriff's Office at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia within the legal hours of sale on the first Tuesday in April, to wit, April 4, 2017, the following described property (the "Subject Property"): All that certain real property situate, lying and being on St. Simons Island, in Glynn County, Georgia, and being UNIT NUMBER 11, BUILDING "J" OF OCEAN WALK, A CONDOMINIUM, (the "Unit") as shown on that certain Condominium Plat dated April 29, 1997, (last revised September 13, 1998), prepared by Freeman-Vaughn Engineering, Inc., certified by Michael A. Hussey, Georgia Registered Land Surveyor No. 2509, recorded in Plat Drawer 25, Page 56, in the office of the Clerk of Superior Court in Glynn County, Georgia. The Unit is a part of the property described in Exhibit "A" to the Declaration of Condominium for Ocean Walk, a Condominium dated October 7, 1998, and recorded in Deed Book 553, Page 85, aforesaid records (the "Declaration"). The Unit includes an undivided interest in the common elements of Ocean Walk, a Condominium, as set forth in the Declaration, together with all of the right, title and interest of Grantor in said Unit and the appurtenances thereto under said Declaration. The above-described Condominium Plat, the Declaration of Condominium and any recorded amendments thereto, or other documents which comprise a part of the Condominium Instruments are incorporated herein by reference and made a part thereof. Any reference to the Declaration made in this deed shall be deemed to include any recorded amendments thereto. Parcel # 04-10893 Ocean Walk Condominium Association, Inc.'s foreclosed lien on the Subject Property in the amount of $37,570.32 pursuant to the Judgment and Order Foreclosing Lien dated June 22, 2016, plus additional applicable fees, costs, and interest accrued since the entry of said Judgment and Order Foreclosing Lien, have been and are hereby declared due because of the failure to pay the indebtedness as and when due and in the manner provided by the Declaration, the aforementioned Judgment and Order Foreclosing Lien, and applicable Georgia law. The debt remaining in default, this sale will be made for the purpose of paying same and all expenses of the sale, as provided in the Georgia Condominium Act, O.C.G.A. Section 44-3-70 et seq., and the Declaration (notice of attempt to collect attorney's fees having been given). The excess, if any, will be distributed to the person or persons legally entitled thereto. To the best of the knowledge and belief of the undersigned, the party in possession of the Subject Property known as 850 Mallery Street, Unit #11-J is Elizabeth K. Bassett and or Zelma R. Kellam. The Subject Property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable, (b) any matters which might be disclosed by an accurate survey and inspection of the property, (c) the Declaration, as amended from time to time, and (d) all matters of record superior to the association lien first set out above, including but not limited to any encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the association lien first set out above. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the United States Bankruptcy Code, and (2) final confirmation and audit of the status of the lien with the holder of the Judgment and Order Foreclosing Lien. The above-referenced sale will proceed unless a timely order from a court of competent jurisdiction is obtained stopping or enjoining the Sheriff of Glynn County, Georgia from conducting the sale.
